Terms and Conditions

Please read these terms and conditions carefully before using our car rental services. By making a booking with RentSmartCars, you agree to be bound by these terms.

Important Notice

These terms and conditions constitute a legally binding agreement between you and RentSmartCars. By proceeding with a booking, you acknowledge that you have read, understood, and agree to be bound by all terms outlined below.

1 Definitions

In these Terms and Conditions, the following definitions apply:

"Rental Agreement"

The contract between RentSmartCars and the Renter for the hire of a Vehicle.

"Renter"

The person or entity identified as the renter in the Rental Agreement.

"Vehicle"

The motor vehicle described in the Rental Agreement and its equipment, keys, and documents.

"Rental Period"

The period between the commencement and termination of the rental.

2 Eligibility Requirements

To rent a vehicle from RentSmartCars, you must meet the following requirements:

  • Be at least 21 years of age (25 years for luxury and premium vehicles)
  • Hold a valid driver's license for at least 2 years
  • Present a valid passport or Emirates ID (for UAE residents)
  • Provide a valid credit card in the renter's name for security deposit
  • Have no major traffic violations or criminal record

Note: Additional documentation may be required for international renters. Please contact our support team for specific requirements.

3 Reservations and Bookings

All reservations are subject to vehicle availability and confirmation by RentSmartCars.

Booking Process:

  • Reservations can be made online, by phone, or in person
  • A confirmation email will be sent upon successful booking
  • RentSmartCars reserves the right to refuse any booking
  • Vehicle models are subject to change based on availability

Modification Policy:

  • Modifications can be made up to 24 hours before pickup
  • Rate changes may apply based on modification
  • Contact our support team for modifications

4 Rental Period and Extensions

The rental period begins at the date and time specified in the Rental Agreement and continues until the vehicle is returned to RentSmartCars.

Rental Period Guidelines:

  • Minimum rental period is 24 hours
  • Vehicles must be returned during business hours unless prior arrangements are made
  • Late returns may incur additional charges
  • Early returns do not qualify for refunds of unused days

Extensions:

  • Extensions must be requested at least 6 hours before the scheduled return time
  • Extensions are subject to vehicle availability
  • Additional charges will apply for extended rental periods

5 Rates and Additional Charges

All rates are quoted in UAE Dirhams (AED) and are subject to change without notice.

Included in Base Rate:

  • Basic third-party liability insurance
  • Standard mileage allowance (as specified in rental agreement)
  • Vehicle maintenance and servicing
  • 24/7 roadside assistance

Additional Charges:

  • Additional driver fee: AED 50 per day
  • Young driver surcharge (under 25): AED 30 per day
  • Airport pickup/drop-off fee: AED 100
  • Delivery and collection charges (outside designated areas)
  • Excess mileage charges
  • Fuel service charge (if vehicle returned without full tank)
  • Traffic violation processing fees

6 Payment Terms

Payment Methods:

  • Credit Cards (Visa, MasterCard, American Express)
  • Debit Cards (UAE-issued only)
  • Cash (UAE Dirhams only)
  • Bank Transfer (for corporate accounts)

Security Deposit:

  • A security deposit is required for all rentals
  • Deposit amount varies by vehicle category (AED 1,000 - AED 5,000)
  • Deposit will be refunded within 7-14 business days after vehicle return
  • Deductions may be made for damages, traffic fines, or other charges

Billing:

  • Full payment is required at vehicle pickup
  • Additional charges will be billed after vehicle return
  • Receipts will be provided for all transactions

7 Driver Requirements and Responsibilities

Primary Driver Responsibilities:

  • Must present valid driving license and identification
  • Is responsible for the vehicle during the rental period
  • Must comply with all UAE traffic laws and regulations
  • Is liable for all traffic violations and fines

Additional Drivers:

  • Must be registered at the time of rental
  • Must meet the same eligibility requirements as primary driver
  • Additional fees apply for each extra driver

Prohibited Activities:

  • Driving under the influence of alcohol or drugs
  • Using mobile phone while driving without hands-free
  • Off-road driving (unless vehicle is specifically designed for such use)
  • Transporting illegal substances or materials
  • Racing or participating in motorsports

8 Vehicle Use and Restrictions

Permitted Use:

  • Personal and business use within UAE borders
  • Transportation of passengers and personal belongings
  • Commuting to and from work
  • Leisure travel within the UAE

Restrictions:

  • Vehicles may not be taken outside UAE borders without prior written permission
  • No towing or pushing of other vehicles without authorization
  • No use for ride-sharing services (Uber, Careem, etc.)
  • No use for delivery services or commercial transportation
  • No use for driving instruction

Vehicle Care:

  • Keep vehicle clean and in good condition
  • Use recommended fuel type only
  • Report any mechanical issues immediately
  • Do not smoke in the vehicle
  • Do not transport pets without proper protection

9 Insurance Coverage

All rentals include basic insurance coverage as required by UAE law.

Standard Coverage:

  • Third-party liability coverage up to AED 2,000,000
  • Fire and theft protection
  • 24/7 roadside assistance

Optional Coverage:

  • Collision Damage Waiver (CDW) - reduces excess amount
  • Theft Protection (TP)
  • Personal Accident Insurance
  • Personal Effects Coverage

Exclusions:

  • Damage to tires, windscreen, or undercarriage
  • Theft of personal belongings
  • Damage due to negligence or violation of terms
  • Damage occurring outside UAE borders
  • Consequential losses or damages

Important: Insurance coverage is void if the driver is under the influence of alcohol or drugs, or if the vehicle is used in violation of these terms and conditions.

10 Cancellation and Refund Policy

Cancellation Timeframes:

  • More than 48 hours before pickup: Full refund
  • 24-48 hours before pickup: 50% refund
  • Less than 24 hours before pickup: No refund
  • No-show: No refund

Modification Policy:

  • Modifications can be made up to 24 hours before pickup
  • Rate differences will apply based on changes
  • No modification fees apply

Special Circumstances:

  • Flight cancellations or delays: Full refund with proof
  • Medical emergencies: Full refund with documentation
  • Severe weather conditions: Case-by-case assessment

Flexible Option: Consider our flexible rate which allows free cancellations up to 24 hours before pickup.

11 Liability and Indemnification

Renter's Liability:

  • All traffic violations and fines during rental period
  • Damage to vehicle beyond normal wear and tear
  • Theft or loss of vehicle and its components
  • Loss of use charges while vehicle is being repaired
  • Towing and storage charges if applicable

RentSmartCars' Liability:

  • Mechanical failures covered under warranty
  • Provision of replacement vehicle when available
  • Roadside assistance services
  • Compliance with safety and maintenance standards

Limitation of Liability:

  • RentSmartCars is not liable for consequential damages
  • Maximum liability is limited to the rental charges paid
  • Not liable for loss of personal belongings
  • Not liable for delays or inconveniences caused by traffic, weather, or other external factors

12 Dispute Resolution and Governing Law

Governing Law:

These terms and conditions are governed by and construed in accordance with the laws of the United Arab Emirates, and the courts of Dubai shall have exclusive jurisdiction over any disputes.

Dispute Resolution Process:

  • Step 1: Informal negotiation with RentSmartCars management
  • Step 2: Mediation through Dubai Courts Mediation Center
  • Step 3: Arbitration in accordance with UAE arbitration laws
  • Step 4: Litigation in Dubai courts if necessary
